1. Who we are

ridgeby.com ("Ridgeby," "we," "us," or "our") is operated by Little Red Apple Productions LLC, a Virginia limited liability company doing business as Ridgeby, with a business address at 529 Jefferson Ave N, Pulaski, VA 24301. Ridgeby is a marketing operator serving roofing contractors and other home-service businesses in the New River Valley region of Virginia.

2. Accepting these terms

These Terms of Service (the "Terms") govern your access to and use of the Ridgeby website at ridgeby.com, including any subdomains, pages, forms, chat widget, and click-to-call features (collectively, the "Site").

By using the Site — including by browsing pages, submitting a form, starting a chat, tapping a call button, or receiving a text from us — you agree to these Terms. If you do not agree, do not use the Site.

You must be at least 18 years old to submit a form or otherwise contact us through the Site.

3. Using the site

You agree to use the Site only for lawful purposes and only in ways that do not infringe our rights or restrict any other person's use of the Site. Specifically, you agree not to:

• Submit false, misleading, or impersonating information through any form on the Site.
• Attempt to gain unauthorized access to the Site, its server, or any related system.
• Send spam, malware, or automated traffic to the Site or any form on it.
• Scrape, mirror, or republish the Site in whole or in substantial part without our written permission.
• Use the Site to compete with Ridgeby by systematically extracting business information or content.

4. Form submissions and lead requests

The Site includes a lead form that asks for your name, business name, cell phone number, city, number of crews, and current monthly marketing spend. When you submit the form:

• You confirm that the information you provide is accurate and that the cell phone number you provide belongs to you or is one you are authorized to use.
• You consent to being contacted by Ridgeby at that number and by email if provided, using SMS, phone calls, and email, in response to your request.
• You understand that submitting the form does not create a contract for services with Ridgeby. It is a request for a conversation. Any actual engagement to provide marketing services is documented in a separate written service agreement.

5. SMS and calls

If you provide your phone number, you consent to receive SMS text messages and phone calls from Ridgeby related to your inquiry, including messages sent by an automated system. Message and data rates from your carrier may apply. You can opt out of further SMS at any time by replying STOP to any message we send you, or by emailing us using the contact information below. Opting out of SMS does not opt you out of email or phone calls that are directly responsive to a request you made.

Phone calls placed to or received from the tracking number displayed on the Site may be recorded for quality, training, and record-keeping purposes. If you do not want your call recorded, please tell us at the start of the call or contact us by another method.

6. Nothing on this site is a service agreement

The Site describes the marketing services Ridgeby offers, including the packages, pricing, guarantees, ownership terms, and cancellation terms. Those descriptions are marketing summaries. The binding terms of any engagement — including scope, deliverables, pricing, guarantees, ownership of assets, cancellation, and refund policies — are set out in a separate written service agreement signed by both you and Ridgeby.

If there is any conflict between the Site and a signed service agreement, the signed service agreement controls.

7. Ownership of site content

All content on the Site — including the Ridgeby name, logo, wordmark, page copy, imagery, illustrations, code, and design — is owned by Little Red Apple Productions LLC or is used with permission, and is protected by U.S. copyright and trademark law.

You may view the Site and share links to it. You may not copy, republish, modify, distribute, or create derivative works from the Site's content without our prior written permission, except that you may quote short excerpts with attribution for commentary, review, or news reporting under fair use.

8. Third-party services on the site

The Site uses third-party services to run the lead form, chat widget, click-to-call number, analytics, and booking calendar. These services may set cookies or collect information about your device and interactions. Our current use of third-party services is described in our Privacy Policy. Your use of those third-party services is subject to their own terms, which you should review if you interact with them (for example, by opening the chat widget or clicking a link to a booking calendar).

9. Disclaimer of warranties

The Site is provided "as is" and "as available" without warranty of any kind. To the fullest extent permitted by law, Ridgeby disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted, error-free, secure, or free of harmful components.

Anything on the Site that describes marketing outcomes, lead volume, cost per lead, close rates, or business results is illustrative and is not a guarantee. Actual results depend on many factors specific to your business, market, and execution, most of which are outside our control.

10. Limitation of liability

To the fullest extent permitted by law, Ridgeby, its owners, members, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Site — including lost profits, lost revenue, lost data, lost business opportunities, or loss of goodwill — even if we have been advised of the possibility of such damages.

In any event, our total liability to you for any and all claims arising out of or related to the Site is limited to one hundred U.S. dollars ($100.00). This limit applies whether the claim is based in contract, tort, statute, or any other legal theory.

Some jurisdictions do not allow certain limitations on liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Little Red Apple Productions LLC, its owners, members, employees, and contractors from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.

12. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Pulaski County, Virginia, and you consent to the personal jurisdiction and venue of those courts.

You and Ridgeby each waive any right to a jury trial and any right to participate in a class action related to the Site or these Terms.

13. Changes to these terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page, and, for material changes, we will post a notice on the Site's home page for a reasonable period. Your continued use of the Site after the updated Terms take effect means you accept the updated Terms.
